These terms are an agreement between you and Matter Development ("we", "us"), the maker of Sneezecast. They cover the Sneezecast iPhone app, Sneezecast Plus and the website at sneezecast.matterdevelopment.com. By using any of them, you agree to these terms. Our privacy policy explains what happens to your data.
In short
- Sneezecast helps you plan around pollen. It is not medical advice, and forecasts can be wrong.
- Your diary lives on your iPhone. If you delete the app or lose your phone, it can be lost.
- Sneezecast Plus is a subscription through Apple that renews until you cancel it in your iPhone's Settings.
- Use Sneezecast for yourself and your family, and don't misuse the service.
Not medical advice
Sneezecast offers decision support, not medical advice. It does not diagnose, treat, cure or prevent any condition. Your trigger read, sneeze forecast, allergy fingerprint and allergist report are estimates made from your own diary and public forecasts; they are a starting point for a conversation with your doctor, not a replacement for one. Don't start, stop or change a medicine because of what the app says without talking to your doctor or pharmacist.
A severe reaction or trouble breathing? Call 911 or your local emergency number. Don't rely on Sneezecast in an emergency.
Forecasts and data
Pollen forecasts come from Google's Pollen API, air quality from the EPA's AirNow and, with Sneezecast Plus, wind and rain from the US National Weather Service. Forecasts cover the United States. We pass them on as they come and can't promise they are complete, accurate or available at any given moment. Pollen varies street by street and hour by hour, and a forecast is only a forecast.
The pollen forecast comes from Google Maps Platform. By using Sneezecast, you also agree to Google's Terms of Service and the Google Maps/Google Earth Additional Terms of Service, and Google's Privacy Policy applies to that data.
Who can use Sneezecast
You need to be at least 18, or the age of majority where you live, to use Sneezecast on your own. A parent or guardian can keep a diary for their child in the app and is responsible for that use.
Your diary and your phone
You don't need an account. Your diary and everything else you log is stored on your iPhone, so you are responsible for it: if you delete the app, reset your phone or lose it, the diary can be lost and we can't restore it, because we never had a copy. Anything you share from the app, such as an allergist report, goes where you send it.
Sneezecast Plus
Sneezecast is free to use. Sneezecast Plus adds features such as your ranked triggers, your sneeze forecast and the allergist report. In the United States it costs $29.99 a year with a 7-day free trial, or $4.99 a month; the app shows the current price before you buy.
- Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends.
- The subscription renews automatically at the same price and length unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
- Manage or cancel it in the iOS Settings app: your name → Subscriptions → Sneezecast. Plus stays active until the end of the period you paid for.
- If you subscribe during a free trial, any unused part of the trial ends.
- Apple handles payments and refunds. To ask for a refund, go to reportaproblem.apple.com.
- We may change prices or what Plus includes. A price change never applies to a period you already paid for, and Apple tells you about it before it affects your subscription.
The App Store licence
The app is licensed to you, not sold, under Apple's standard Licensed Application End User License Agreement. These terms add to it. Apple is not a party to these terms and is not responsible for Sneezecast or for supporting it; we are.
Using Sneezecast fairly
Use Sneezecast for your own personal use and your family's. Please don't:
- copy, resell or redistribute the forecasts, the app or its drawings;
- send automated requests to the Sneezecast server, overload it, or try to get around its limits;
- try to break into, take apart or interfere with the app, the server or the website, except as the law allows;
- use the contact form for spam, sales pitches or anything unlawful.
If you do, we may block your access to the service.
What's ours
The app, the website, their text and design, and the plant drawings belong to Matter Development and are protected by law. These terms don't give you any rights to them beyond using Sneezecast as described here. If you send us ideas or feedback, we may use them freely and without paying you; thank you.
Changes and availability
We keep improving Sneezecast, so features may change, and we may pause or end a part of the service, including a data source we depend on. If we stop offering Sneezecast Plus, we will stop renewals; Apple handles any refund owed.
Disclaimers
To the extent the law allows, Sneezecast is provided "as is" and "as available", without warranties of any kind, including that it will be accurate, uninterrupted or free of errors, or fit for a particular purpose. Some places don't allow these exclusions, so some of them may not apply to you.
Liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for decisions you make based on a forecast. Our total liability for any claim about Sneezecast is limited to the amount you paid for Sneezecast Plus in the 12 months before the claim, or $50, whichever is more. Nothing in these terms limits liability that cannot lawfully be limited, or rights you have as a consumer that cannot be waived.
Changes to these terms
If we change these terms, we will post the new version here with a new date. If you keep using Sneezecast after that, the new terms apply. If you don't agree with them, stop using Sneezecast and cancel Sneezecast Plus.
